Terms and Conditions

1. Introduction
1.1. These Terms and Conditions govern your participation in The 44 Club charity lottery ("the Lottery"), operated by Herefordshire Samaritans ("we", "us", "our"). By entering the Lottery, you agree to be bound by these Terms and Conditions.
1.2. We reserve the right to amend these Terms and Conditions at our discretion at any time. Any significant changes will be published on our website or communicated to you directly using the contact details you provided on registration.
1.3. A copy of these Terms and Conditions is available on our website and may be requested via our contact page.
2. About the Lottery
2.1. For the purpose of the Gambling Act 2005, The 44 Club is defined as a "Small Society Lottery", registered with Herefordshire Council.
2.2. The Lottery is promoted by and on behalf of Herefordshire Samaritans, a registered charity in England and Wales (No. 1167937), whose registered office is at The Samaritans, 44a Berrington Street, Hereford, HR4 0BJ.
2.3. The registered Responsible Person for the Lottery is Alex Hempton-Smith, Trustee.
2.4. Net proceeds from the Lottery go to Herefordshire Samaritans to support its charitable work, minus the cost of running the Lottery.
3. Eligibility
3.1. The Lottery is open to all residents of the United Kingdom who are aged 18 (eighteen) or over. We reserve the right to verify the age of any participant.
3.2. Underage gambling is an offence. Any person found to be under 18 years of age automatically forfeits the right to any prize.
3.3. Employees of Herefordshire Samaritans and their immediate family members may participate in the Lottery but must declare any wins. A family member is considered to be a spouse, partner, close blood relation, or spouse of a close blood relation.
3.4. If we have reason to believe a participant is under the age of 18, resides outside the United Kingdom, or is acting on behalf of someone else, we reserve the right to terminate their participation and forfeit any winnings.
4. Entering the Lottery
4.1. To enter the Lottery, you must purchase one or more lottery tickets via our website. All tickets are priced at £5 per calendar month.
4.2. When you purchase a ticket, a unique ticket number will be generated by random selection through secure computer software. This number will be issued to you by email. Ticket numbers cannot be chosen by participants.
4.3. Each ticket is unique and has a serial number. This serial number is used to determine winners.
4.4. Full payment for each ticket must be received in cleared funds before the ticket can be entered into a draw. Only tickets for which full payment has been received are eligible to win a prize.
4.5. All participants acknowledge that their payment to enter the Lottery does not guarantee that they will win any prize.
5. Subscriptions
5.1. Tickets may be purchased on a recurring subscription basis. Subscriptions automatically renew each month unless cancelled.
5.2. We encourage subscribers to pay for multiple months in advance in order to reduce payment processing fees for the charity.
5.3. Payments are processed via Stripe. By subscribing, you authorise us to collect recurring payments from your chosen payment method.
5.4. You may cancel your subscription at any time through your account on our website. Cancelled subscriptions remain active until the end of the paid period. No refunds are given for the current or pre-paid billing period upon cancellation.
5.5. If a payment fails, we may reattempt collection. If payment cannot be collected, your ticket will not be entered into the draw until payment is received.
6. One-Off Purchases
6.1. One-off ticket purchases are valid only for the selected draw(s).
6.2. Payment is taken at the time of purchase via Stripe.
6.3. No refunds are available once tickets have been purchased. All participants acknowledge that their payment to enter the Lottery does not guarantee that they will win any prize.
7. The Draw
7.1. Draws take place monthly, on the last day of each calendar month. We reserve the right to amend the draw date at our discretion. If the scheduled draw date falls on a day where the draw cannot take place, it will be held on the next available day.
7.2. Three winning numbers are selected using a certified random number generator in a secure environment. You do not need to be present at the draw to win.
7.3. In the rare event that any error occurs and tickets are not entered into a draw, unentered tickets will instead be entered into the next available draw.
7.4. If there is a cancelled draw, we may refund your entry fee on request or credit the fee to the next draw. We will not refund you if a draw is delayed or postponed, as your ticket will still be entered into the delayed or postponed draw.
8. Prizes
8.1. 50% of each month's ticket sales form the prize fund. The remaining 50% goes directly to Herefordshire Samaritans' charitable work.
8.2. The prize fund is distributed as follows:

1st place: 50% of the prize fund

2nd place: 30% of the prize fund

3rd place: 20% of the prize fund
8.3. Prize amounts will vary from draw to draw depending on the number of tickets sold. As we are a new lottery, we are not yet able to provide an estimate of the odds of winning.
8.4. Winners will be notified directly by email following the draw. All ticket holders will also be emailed a summary of the draw results.
8.5. Prizes will be paid by bank transfer within 7 working days of the draw. Prize payments require valid UK bank account details.
8.6. Where we are not provided with sufficient information to make a payment, we will make every effort to contact the winner to obtain the required details.
8.7. Any prize not claimed within 90 days of the draw will be treated as a donation to Herefordshire Samaritans.
8.8. We reserve the right, in exceptional and unforeseen circumstances, to substitute any prize for a prize of equivalent value at our absolute discretion.
9. Publication of Winners
9.1. By entering the Lottery, you agree that if you win, your first name and the initial of your surname (e.g. "John D") may be published on our website, in emails to other players, and in promotional material.
9.2. Should you wish to opt out of having your name published, please contact us via our contact page. Withdrawal of consent may not affect materials already in circulation.
10. Your Account
10.1. To participate in the Lottery, you must create an account on our website with a valid email address and password.
10.2. You are responsible for keeping your account credentials confidential and secure at all times. Any transactions made through your account are accepted on the understanding that they were made by you.
10.3. If your account has been accessed by a third party and we have not been informed, we accept no liability for any transactions made.
10.4. We permit only one account per person.
10.5. All participants are solely responsible for providing and, where necessary, updating us with their accurate and up-to-date contact details. We will not be liable for any failure to contact a participant due to errors, omissions, or inaccuracies in the contact details provided.
11. Data Protection
11.1. We are committed to protecting your privacy. Personal data collected from you is used lawfully in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
11.2. Your data is used for the purpose of processing lottery entries, managing your account, entering you into draws, and informing winners that they have won a prize.

11.4. Should you wish to change your communication preferences at any time, you can update them through your account or by contacting us via our contact page.
12. Limitation of Liability
12.1. We shall not be liable to any participant for any loss or damage suffered or arising from:

any delays or failures in the postal service, email service, or other communication methods;

any delays or failures in any software or systems used for the administration of the Lottery;

any delays or failures in banking or payment systems;

any refusal to accept an individual's entry;

any failure to enter a ticket into a draw;

any event beyond our reasonable control.
12.2. We accept no liability for loss, theft, or delay of prize payments.
12.3. We shall not be liable in contract, tort, negligence, or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Lottery, including loss of the opportunity to enter the Lottery and/or the chance of winning a prize.
12.4. Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability which cannot legally be limited or excluded.
12.5. We reserve the right to:

disqualify or decline to accept the entry of any participant if we have reasonable grounds to believe they have breached these Terms and Conditions or acted fraudulently;

terminate, amend, cancel, or suspend the Lottery for reasons beyond our reasonable control.

Please provide full details of your complaint along with any supporting information. We will endeavour to resolve all complaints promptly and fairly.
14. Responsible Gambling
14.1. The 44 Club is a form of gambling. Participants are encouraged to gamble responsibly.
14.2. Should gambling become a problem, we recommend you contact the National Gambling Helpline on 0808 8020 133 or visit www.begambleaware.org.
14.3. If you wish to exclude yourself from further participation in the Lottery, you may do so at any time by contacting us via our contact page. Self-exclusion will apply for a minimum period of six months.
15. Changes to Terms
15.1. We may update these Terms and Conditions from time to time. Any changes will be published on our website and, where appropriate, communicated to participants directly.
15.2. Continued participation in the Lottery after changes have been published constitutes acceptance of the updated Terms and Conditions.
15.3. Each participant should retain a copy of these Terms and Conditions for their reference.
16. Governing Law
16.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
16.2. All participants hereby submit to the exclusive jurisdiction of the English courts.
